First Insight is a leader in providing companies insights about their products and services. When we collect information from panelists about their opinions on our customers’ products and services, we do so at our customers’ direction. That information may sometimes include personal data. If you have any questions about information collected from you as part of a survey or game, please contact the brand sponsoring the survey or game.

Information We Collect Automatically

When you visit our website, our server automatically collects certain browser or device-generated information, which may in some cases constitute personal data, including but not limited to:

  • your domain;
  • your IP address;
  • your date, time and duration of your visit;
  • your browser type;
  • your operating system;
  • your page visits;
  • information from other entities;
  • other information about your computer or device;
  • Internet traffic.

We do not use this automatically collected information to try to identify you by name, and we do not associate it with the information you provide voluntarily. Please see the section “Cookies and Other Tracking Mechanisms” below for more information.

 

Information You Provide

In order to access or use certain portions of the website or enjoy the full functionality of the website, or otherwise when conducting business with us or seeking to conduct business with us, you may be prompted to provide certain personal data to us in the following ways:

  • by filling in forms (for example, a 'Contact us' form) on our website or at a trade show or anywhere else we conduct business;
  • by using the InsightSUITE Platform;
  • by downloading documentation from our website;
  • by subscribing to newsletters or other communications; or
  • by corresponding with us by phone, e-mail or otherwise using our contact details.

Typically, the personal data you give us may include name, title, business affiliation, business address, telephone number, and email address, any personal details that may be required to resolve any enquiries or complaints, and other information that you choose to provide to us. Some of the personal data that we collect from you is required to enter into a contract with you (such as in anticipation of an employment contract or a services agreement) or to perform a contract with you (such as to provide services at your request), and failure to provide any information may result in our inability to provide requested services or products, or to consider your application for employment.

 

Information from Other Sources

We may also obtain contact information [and employment details] about you from other entities such as tradeshow organizers, partners, including publicly accessible sources such as LinkedIn and other social networks.

 

InsightSUITE Platform

If you are an authorized user of the InsightSUITE Platform, we collect your email address, user name, password, IP address and create logs of your use of the InsightSUITE Platform. We use those logs to secure the Portal, perform our agreements with our customers and enforce those agreements.  

When we act in our capacity as provider of the Portal to our customers, we use the collected information for the purpose of providing the requested service to the customer (who may be your employer) in accordance with our agreements with that customer; we also collect and analyze data and other information relating to the provision, use and performance of various aspects of our services and related systems and technologies. We use such information to improve, enhance, develop, diagnose and correct the services provided via the Portal. We do not otherwise use information that we collect through the Portal unless permitted by our agreements with our customers, required by law, to protect our rights and interests, or to protect the rights and interests of our customers.

Use of Personal Data

The following is an overview of our purposes for using your personal data. Additional details on how we process your personal data may be provided to you in a separate notice or contract.

We use the personal data we collect for the following purposes:

  • conducting and develop our business with you and with others, as more fully described below;
  • providing you with any services or products you have contracted for;
  • administering and managing performance of purchase or sales agreements with our suppliers and customers;
  • providing after-sales support;
  • processing, evaluating and completing certain transactions involving the website, and more generally transactions involving First Insight's products and services;
  • operating, evaluating, maintaining, improving and developing the website (including by monitoring and analyzing trends, access to, and use of the website for advertising and marketing);
  • evaluating, improving and developing our products and services generally;
  • customizing our website to visitors' needs;
  • engaging you about events, promotions, the website and First Insight's products and services;

  • assisting us in advertising our website and services on our and other websites and assisting us in evaluating the success of our advertising campaigns in various platforms;
  • protecting and ensuring security and safety of the website, First Insight confidential and proprietary information, and First Insight employees;
  • managing, protecting against and investigating fraud, risk exposure, claims and other liabilities, including but not limited to violation of our contract terms or laws or regulations;
  • using your personal data in connection with a potential or actual merger or sale of our company or any of our assets or securities, or those of any affiliated company, or as part of an investment or a bankruptcy proceeding, in which case personal data held by us about our users may be one of the transferred assets;
  • other purposes as authorized or required by law, including responding to legal process, law enforcement requests, bringing or defending litigation or other disputes, and maintaining adequate books and records.

 

Disclosure of Personal Data

First Insight from time to time will share your personal data with our affiliated businesses for the purposes described above. We may also appoint service providers (who will operate under our instructions) to assist us in providing information, products or services to you, in conducting and managing our business, or in managing and improving our products, services or the website. First Insight may share your personal data with these service providers to perform services that the service providers have been engaged by First Insight to perform on First Insight's behalf, subject to appropriate contractual restrictions and security measures. First Insight may also share your personal data if we believe it is reasonably necessary to prevent harm or loss, if we believe that the disclosure will further an investigation of suspected or actual illegal activities, or to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena. In addition, we may share your personal data in connection with a potential or actual financing, merger or sale of our company or any of our assets or securities, or those of any affiliated company, or as part of a bankruptcy proceeding, in which case personal data held by us about our users may be one of the transferred assets.

First Insight reserves the right to share any information that you provide that is not deemed personal data and is not otherwise subject to contractual restrictions. We may share aggregate or de-identified information about users with other entities for marketing, advertising, research or similar purposes; however, we do not share your personal data with other entities for their own marketing purposes.

 

Cookies and Other Tracking Mechanisms

We and our service providers use cookies and other tracking mechanisms to track information about your use of our website. We may combine this information with other personal data we collect from you (and our service providers may do so on our behalf). Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our website, while others are used to allow us to track your activities at our website. Clear GIFs, pixel tags and other technologies.

Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We and our service providers (including Google Analytics) may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our website to, among other things, track the activities of website visitors, help us manage content, and compile statistics about website usage. We and our service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Do-Not-Track

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions in the Ad Networks section.

Analytics

We use automated devices and applications, such as Google Analytics, to evaluate usage of our website and our services. We also may use other analytic means to evaluate our website. We use these tools to help us improve our website’s and services’ performance and user experiences. The entities that operate these tools may use cookies and other tracking technologies, such as web beacons or local storage objects (LSOs), to perform their services in accordance with their own privacy policies. We and our service providers may use the information that we collect about you (whether directly from you from our website, through your device(s), or from another entity), and notably IP addresses, to help us and our service providers identify other devices that you use (e.g., a mobile phone, tablet, other computer). We, and our service providers, also may use the cross-device and browser tracking and other information we learn about you to serve targeted advertising on your devices and to send you emails. To opt-out of cross-device and browser advertising, you may follow the instructions set forth in the Ad Networks section below. Please note: if you opt out of these targeted advertising cookies, your opt-out will be specific to the web browser or mobile device from which you accessed the opt-out. Ad Networks

We may use network advertisers, network providers, advertisers, sponsors and/or traffic measurement services (“Advertisers”) to serve advertisements on our website and on other entities’ websites or other media (e.g., social networking platforms). This enables us and these Advertisers to target advertisements to you for products and services in which you might be interested. Advertisers may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These cookies and other technologies are governed by each Advertiser’s specific privacy policy, not this one. We may provide these Advertisers with information, including personal data, about you.

Users in the United States may opt out of many ad networks. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page for information about opting out of interest-based advertising and your choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative (“NAI”) Consumer Opt-Out Page for information about opting out of interest-based advertising and your choices regarding having information used by NAI members.

Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our website or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. Children

Our website is not for use by children under the age of 16 years and First Insight does not knowingly collect, store, share or use the personal data of children under 16 years. If you are under the age of 16 years, please do not provide any personal data, even if prompted by the website to do so. If you are under the age of 16 years and you have provided personal data, please ask your parent(s) or guardian(s) to notify First Insight and First Insight will delete all such personal data.

 

Marketing

Where lawful to do so, and subject to your consent where required, we may communicate with you by SMS and email to tell you about our products and services. If you wish to opt-out of receiving marketing communications, please use the 'unsubscribe' instructions provided in our emails or text the STOP number in our SMS, or otherwise contact us directly and we will stop sending you communications. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about any services you have requested or received from us.

 

Access to My Personal Information

You may modify personal data that you have submitted by contacting us at data.protection@firstinsight.com. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the website for a period of time.

First Insight aims to safeguard and protect your personal data from unauthorized access, improper use or disclosure, unauthorized modification or unlawful destruction or accidental loss, and First Insight utilizes and maintains certain reasonable processes, systems, and technologies to do so. However, you acknowledge that no transmission over the Internet is completely secure or error-free, and that these processes, systems, and technologies utilized and maintained by First Insight can be compromised by outside intruders. Use of Personal Data

All processing and use of your personal data is justified, and in the majority of cases, processing will be justified because you have consented to the processing, expressly or by implication. In other instances, the processing of your personal data will be authorized by applicable privacy law or may even be required by law. For example:

 

  • the processing may be necessary to perform a contract with you or to take steps to enter into a contract at your request, such as to fulfil an order, to review your job application, or to provide product information you have requested;
  • the processing is necessary for us to comply with a relevant legal obligation, such as keeping accounting records or to verify employment eligibility;
  • the processing is in our legitimate interests, and is reasonable, and we have provided you with prior notice of the intended processing; or you have expressly consented to the processing.

 

Access/Correction Requests for Canadian Residents

Upon request, we will provide you with access to your personal data under the control of First Insight, subject to statutory exceptions. We will also process your requests to correct your personal data.

Access and correction requests must be made in writing to the email address set out at Contact Information. We will endeavor to respond to your requests within 30 days.

If we are unable to provide access or make a requested correction, we will explain the reasons for this and outline any further recourse available to you. In some cases, we may charge a fee to respond to your access/correction request.

 

Location of Personal Data

First Insight generally stores personal information in the USA and we use service providers in various countries. Accordingly, your personal data may be transferred or stored outside of your jurisdiction of residence, and will be accessible to law enforcement and regulatory authorities according to the applicable laws of such jurisdictions.

Data Controller

For the purposes of the EU and UK GDPR, First Insight Inc. is the controller of any personal data collected from website visitors, from customers or vendors or otherwise for the purpose of conducting or developing our business with you, and for log information from users of the InsightSUITE Platform. When the EU or UK GDPR applies, personal data means any information relating to an identified or identifiable person. All processing and use of your personal data is justified by a condition (called a legal basis) for processing. In the majority of cases, our purposes for processing will be justified as described below:

  • Contract Performance: the processing is necessary to perform a contract with you or take steps to enter into a contract at your request, such as to fulfil an order or to provide product information you have requested;
  • Legal Obligation: the processing is necessary for us to comply with a relevant legal obligation, such as keeping accounting records or to verify employment eligibility;
  • Legitimate Interests: the processing is in our legitimate interests, which are not overridden by your interests and fundamental rights. Transfers of Personal Data

If your personal data is transferred outside the EEA or UK, whether to other First Insight affiliates or to unaffiliated entities (including service providers), we will take steps to ensure that your personal data receives the same level of protection as if it remained within the EEA or UK, including by entering into data transfer agreements using the European Commission approved Standard Contractual Clauses. In some cases, we may rely on your explicit consent to transfer personal data, or the transfer will be necessary (i) to perform a contract to which you are a party or implement pre-contractual measures at your request, (ii) to conclude or perform a contract in the interest of an individual, or (iii) for the establishment, exercise or defense of legal claims.

For transfers of personal data among First Insight affiliates we have put in place European Commission- approved Standard Contractual Clauses. Your personal data may be transferred to India, the United Kingdom, or the United States of America. None of those countries benefits from a decision of the European Commission determining that the country provides adequate protection to personal data. You have a right to obtain information about any contract pursuant to which your personal data is transferred outside of the EEA or UK by contacting us.

 

Retention of Personal Data

We apply a general rule of keeping personal data only for as long as required to fulfil the purposes for which it was collected. In general, we retain your personal data for a period of time corresponding to a statute of limitation setting out the period during which legal claims may be filed in court. For example, we’ll retain your personal data during the statute of limitation period, to maintain an accurate record of your dealings with us. However, in some circumstances we may retain personal data for other periods of time, for instance where we are required to do so in accordance with legal, tax and accounting requirements, or if required to do so by a legal process or procedure, legal authority, or other governmental entity having authority to make the request, for so long as required.

 

Your Rights

  • Right of access, rectification and erasure - you have the right to request access to and obtain a copy of any of your personal data that we may hold, to request correction of any inaccurate data relating to you, and to request the deletion of your personal data under certain circumstances.   • Data portability - where we are relying (as the legal basis for processing) upon your consent, or the fact that the processing is necessary to perform a contract to which you are party or to take steps at your request prior to entering a contract, and the personal data is processed by automatic means, you have the right to receive all such personal data which you have provided us in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible.
  • Right to restriction of processing you have the right to restrict our processing of your personal data (that is, allow only its storage) where:
  • you contest the accuracy of the personal data, until we have taken sufficient steps to correct or verify its accuracy;
  • where the processing is unlawful but you do not want us to erase the personal data;
  • where we no longer need your personal data for the purposes of the processing, but you require such personal data for the establishment, exercise or defense of legal claims; or
  • where you have objected to processing justified on legitimate interest grounds (see below), pending verification as to whether we have compelling legitimate grounds to continue processing.

Where your personal data is subject to restriction we will only process it with your consent or for the establishment, exercise or defense of legal claims.

  • Right to withdraw consent - where applicable, you have the right to withdraw your consent at any time. For example, if you wish to opt-out of receiving electronic marketing communications, you can change your settings in your account on the website, use the 'unsubscribe' link provided in our emails or text the STOP number in our SMS, or otherwise contact us directly and we will stop sending you communications.

  • Right to object to processing (including profiling) based on legitimate interests - where we are relying upon legitimate interests as the legal basis for processing, you have the right to object to that processing on grounds relating to your particular situation. If you object, we must stop that processing unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or we need to process the personal data for the establishment, exercise or defense of legal claims. Where we rely upon legitimate interest as a basis for processing we believe that we can demonstrate such compelling legitimate grounds, but we will consider each case on an individual basis.
